Article 1 - Applicability

These terms and conditions apply to all educational activities (courses, training sessions, study days, conferences, guidance, and consultancy work) organized by ETCB.
By registering or signing up via the website or email, the client agrees to these terms and conditions. These conditions, together with any customized confirmations, form the entire agreement between ETCB and the client.
Additions or changes to these terms are only valid if agreed upon in writing.

Article 2 - Formation of the Agreement

The agreement between ETCB and the client is established through written confirmation or invoicing by ETCB after receipt of the registration.
Clients have the right to a 14-working-day cooling-off period after registration, except when the registration takes place less than 28 days before the start of the course. In that case, the cancellation conditions as described in Article 3 apply.
Cancellations within the cooling-off period must be submitted in writing via registered mail or email.

Article 3 - Cancellation by the Participant/Client

Cancellations must be communicated in writing (via email or post) to ETCB. The cancellation date is determined by the date of receipt.
The costs for cancellation are as follows:

  • Cancellation within 14 days before the start of the course: 100% of the course fees.
  • Cancellation between 14 and 21 days before the start: 75% of the course fees.
  • Cancellation between 21 and 28 days before the start: €50 administration costs.
  • Cancellation more than 28 days before the start: no cancellation fees.
    Replacement by another participant is possible at no extra cost, provided prior written approval from ETCB.

Article 4 - Cancellation by ETCB

ETCB reserves the right to cancel courses up to 14 days before the start, for example, in case of insufficient participants. In such cases, any payments already made will be fully refunded.
In the event of cancellation of themed training due to insufficient participation, ETCB may propose alternative dates or solutions, but the client is entitled to a full refund if no agreement is reached.

Article 5 - Rates and Costs of the Assignment

The rates of ETCB are published on the website. ETCB reserves the right to adjust prices twice a year (on January 1 and August 1). After publication, the new rates also apply to already issued quotations, unless otherwise agreed.
Quotations for customized work are valid for 30 days, unless stated otherwise.
All listed prices are exclusive of VAT unless otherwise indicated. Travel expenses, accommodation costs, and other direct costs may be charged separately if applicable and agreed upon in advance.

Article 6 - Payment

ETCB invoices after the agreement has been concluded or, in the case of customized work, after the completion of the assignment. If a project includes multiple dates, interim invoices may be sent.
Invoices must be paid within 14 days of receipt, unless another term has been agreed upon in writing.
If payment is not made on time, a reminder will be sent. If payment remains outstanding, ETCB reserves the right to charge statutory interest and extrajudicial collection costs in accordance with the Collection Costs Act (WIK).
ETCB reserves the right to block participation in courses or access to materials if payments are not made on time.

Article 7 - Default in Payment

If the client does not pay within the stipulated period after a reminder, he/she is in default, and ETCB has the right to suspend further services until payment is made.
ETCB is entitled to charge extrajudicial collection costs in accordance with the Collection Costs Act (WIK), with a minimum of €40. The amount of collection costs is calculated according to the tier as stipulated in the WIK.
In case of non-payment, ETCB reserves the right to take legal action, with all judicial and extrajudicial costs borne by the client.

Article 8 - Copyright on Course Materials and Recording Policy

ETCB owns the copyright on all provided course materials (except for commercial books). This applies to both physical and digital materials.
It is not allowed to record trainings or other course materials without permission from ETCB. Violations may result in removal from the course without a refund.

Article 9 - Unforeseen Circumstances

In cases not covered by these terms and conditions, the ETCB management will decide.
